Women's rights on the human rights approach

The law protects every human being's right to life. No one shall be intentionally deprived of his or her life except in execution of a court sentence convicting him or her of a crime for which punishment is provided by law. Deprivation of life shall not be considered a violation of this Article if it results from the use of force no more than strictly necessary: in defense of a person from unlawful violence, for the purpose of lawfully arresting him or her or preventing the escape of a person lawfully detained, or in lawful action to suppress a riot or insurrection. The right to life is a fundamental human right and is at the core of the enjoyment of all other human rights. International human rights law recognizes that this fundamental right begins at birth, and international and regional human rights bodies, as well as courts around the world, have clearly affirmed that any prenatal protection must be compatible with women's human rights.

The Comment
The right to life is guaranteed to Muslim women in Islam. Islam forbids the life of a Muslim woman from birth through pregnancy (the idea of abortion) until adulthood, except for a reason that warrants murder. The details are as follows:

A- The Right Not to Be Sterilized in Islam
Permanent Sterilization (Permanent Prohibition)

The ruling: Prohibited by Islamic law unless there is a legitimate necessity
The Permissible Cases: It is permissible in the event of a real or overwhelming danger to the woman's life in the event of pregnancy. This must be based on a reliable medical opinion from a Muslim physician.

Sharia Evidence: Islam aims to preserve the human race and increase the nation's population, and permanent sterilization contradicts these fundamental objectives unless there is a pressing necessity.

Today in the West
Women are being forcibly sterilized in many states in the United States and some European countries. You can read about this at the link below. This is unacceptable in Islam.

B - The Right to Birth Control
Such as spacing pregnancies, preserving the mother's health when she is weak, or for birth control for a legitimate need.

For Necessity Only: Permanent sterilization is permissible in cases of dire necessity and with a reliable medical opinion.

For Interest: Temporary birth control is permissible with the consent of both spouses and in their best interests, provided the method is safe and legal.

Today in the West
and specifically in China, you are certainly aware of the one-child policy pursued by the Chinese government. Second children, especially if they are girls, are forced to be taken from their mothers and placed in remote areas far from the city, places that lack even the most basic rights, such as healthcare or psychological care, with few people to care for them, provide them with care, nutrition, or affection. They are left in these orphanages, some of whom die from a lack of care and affection, while others face the harshness of life from an early age. These orphanages are the worst of their kind in the world with regard to childhood, and specifically with regard to girls.

C - The Right to Abortion
Abortion is forbidden by Islamic law except in cases of extreme necessity to save the mother's life, as determined by trusted doctors. Its ruling varies based on the timing of the procedure: after the soul is breathed into the fetus (120 days), it is absolutely forbidden. However, before that, some jurists have permitted it in cases of urgent necessity, such as saving the mother's life or if the pregnancy resulted from adultery or rape. However, Dar al-Iftaa believes that it is absolutely forbidden except for a legitimate religious necessity.

Today in the West
Abortion is prohibited in some European countries and some US states. Read this paragraph.
The court objects to the idea of abortion in Mississippi if the fetus has reached 15 weeks. In a 6-3 majority decision, the court upheld the Mississippi law, overturning the five-judge majority and ruling that the US Constitution does not grant a right to abortion. By overturning Roe and Casey, the court affirmed that it was returning the regulation of abortion to the people and their elected representatives. Thirteen states have adopted so-called trigger laws, which prohibit abortion and take effect as soon as the constitutional right to abortion is not recognized. Following the Dobbs decision, further restrictions on abortion are expected, such as restrictions on the availability of medication abortion.

D - The Right Not to Be Buried Alive
This is mentioned in a sacred text in the Holy Quran and is still practiced in some Asian countries, including the custom of burying girls alive among some tribes.

God Almighty says:
(And when the girl [who was] buried alive is asked, for what sin she was killed…) Surah At-Takwir

(And when the girl [who was] buried alive is asked, for what sin she was killed…) Surah At-Takwir

This noble verse tells us that the people of Mecca used to bury their daughters alive for fear of the shame of giving birth to girls instead of boys. This was a rejected Arab custom practiced by many, and Islam has unanimously prohibited it.

Today in the West
Read this passage
Sati: A custom in which a woman is buried alive with her deceased husband. It was common in some regions of India. While the most common form was burning a widow alive on her husband's funeral pyre, the practice of burying her alive has also been documented. Evidence also suggests that this practice was common among the Scythians, and possibly other ancient cultures. Legal Status: Sati is officially prohibited in India, but it remains a controversial topic with differing opinions and views on its origins. E - The Right to Prevent Self-Suicide

God Almighty says:
(...And We decreed for the Children of Israel that whoever kills a soul unless for a soul or for corruption in the land - it will be as if he had slain mankind entirely. And whoever saves a life - it will be as if he had saved mankind entirely.) [Al-Ma'idah 5:32]

Therefore, We decreed for the Children of Israel that whoever kills a soul unless for retaliation or corruption in the land or corruption warranting death, such as polytheism or war, it will be as if he had slain mankind entirely, deserving a great punishment from God. And whoever prevents the killing of a soul God has forbidden - it will be as if he had saved mankind entirely. Preserving the sanctity of one soul is preserving the sanctity of mankind entirely. Our messengers came to the Children of Israel with proofs and evidence of the truth of what they are called to believe in their Lord and to do what they were commanded to do. However, many of them, after the arrival of the messengers, transgressed God's limits by committing what He forbade and abandoning His commands.

In the hadith of Abdullah ibn Amr (may Allah be pleased with them both), the Prophet (peace and blessings be upon him) said:

“The destruction of this world is easier for Allah than the killing of a Muslim man” (Narrated by al-Nasa’i).

As stated in the noble hadith: “Women are the sisters of men,” meaning in general Islamic rulings, except for those specifically pertaining to men
Because of this crime of murder, We prescribed for the Children of Israel that whoever kills a soul for no reason, such as retaliation or corruption in the land, or any type of corruption that warrants execution, such as polytheism and warfare, it is as if he had killed all of humanity, deserving of a severe punishment from God. And whoever refrains from killing a soul that God has forbidden, it is as if he had saved all of humanity. Preserving the sanctity of one person is preserving the sanctity of all of humanity. Our messengers brought the Children of Israel proofs and evidence of the truth of what they called them to: faith in their Lord and fulfilling what was enjoined upon them. However, many of them, after the arrival of the messengers, transgressed God's limits by committing what God has forbidden and abandoning His commands.

In a hadith narrated by Abdullah ibn Amr, the Prophet (peace and blessings be upon him) said
"The destruction of the world is easier for God than the killing of a Muslim man." (Narrated by al-Nasa'i)

As stated in the noble hadith (Women are the sisters of men), meaning in general Islamic rulings, except for what is specific to men.

2 - Their Right to Food Security
Women are responsible for half of global food production, and in most developing countries, they produce between 60 and 80% of the food. Yet, they are still considered household producers or farm assistants, not farmers or economic actors in their own right. Women receive a negligible percentage of assistance for agricultural investments; in Africa, women receive less than 10% of small farm loans and 1% of total loans to the agricultural sector. Empowering women farmers is vital to lifting rural communities out of poverty, especially as many developing countries face economic crises, food insecurity, HIV/AIDS, environmental degradation, and increasing urbanization.

The Comment
A- A husband feeding his wife is both an obligation and an act of charity.
The Prophet (peace and blessings be upon him) said:
"You will not spend anything seeking thereby the pleasure of Allah except that you will be rewarded for it, even what you put in your wife's mouth." Agreed upon.

It was narrated on the authority of Al-Irbad ibn Sariyah that he said: I heard the Messenger of Allah, may Allah bless him and grant him peace, say:

"If a man provides water to his wife, he will be rewarded."

Imam Al-Bukhari narrated in his Sahih
On the authority of Abu Mas'ud, from the Prophet, may Allah bless him and grant him peace, who said: "If a man spends on his family, hoping for a reward from Allah, then it is considered charity for him."

B - The right to support her during breastfeeding, even if the mother is divorced from her father. God Almighty said: “Mothers shall breastfeed their children for two complete years for whoever desires to complete the nursing. And upon the father of the child is their food and clothing on equitable terms. No soul shall be charged except [with that within] its capacity. A mother shall not be made to suffer harm on account of her child, nor a father on account of his child. And upon the heir is a similar [shari’ah]. But if [the mother] If they both desire weaning by mutual consent and consultation, there is no blame upon them. But if you wish to have your children nursed by female relatives, there is no blame upon you provided you pay what you have given in an acceptable manner. And fear Allah and know that Allah is Seeing of what you do. (Surat Al-Baqarah: 233)
The wife: She is entitled to maintenance and clothing as usual, including the wages for breastfeeding as a form of maintenance, because breastfeeding serves the husband's interests and is a continuation of the service she has provided him.

The divorced woman: She is entitled to a nursing wage if she is not stubborn, and she can file a lawsuit to obtain a nursing wage.

The duration of the wage
Two years: The nursing wage begins on the date of the child's birth and continues for two years.

After divorce: She is entitled to a nursing wage during the waiting period and can claim it after the waiting period ends.

Important Notes
The father does not have the right to force the divorced woman to breastfeed her child, as breastfeeding is his right.

The husband must pay alimony if the woman requests a nursing wage, whether she breastfeeds the child, hires a wet nurse, or purchases a substitute for the child.

If the child suffers from health problems, the mother has the right to claim the nursing wage as comprehensive alimony

C - Her right to have a guardian in her life
A guardian: a person appointed by a judge to manage and represent the affairs of the insane, the mentally ill, the absent-minded, or the foolish.
We do not say that a woman is not capable of controlling her own affairs and needs a guardian. However, the guardianship of women is an Islamic blessing that is unparalleled in our belief and our limited knowledge of all religions, both heavenly and earthly:

Read this hadith of the Messenger of Allah (peace and blessings be upon him)
Hisham narrated to us on the authority of Qatadah on the authority of Anas (may Allah be pleased with him), who said, "I will tell you a hadith that I heard from the Messenger of Allah (peace and blessings be upon him), which no one else will tell you. I heard the Messenger of Allah (peace and blessings be upon him) say, 'Among the signs of the Hour are that knowledge will be taken away, ignorance will increase, fornication will increase, alcohol will drink more, men will decrease, and women will increase, until there will be one guardian for fifty women.'"

The Role of a Guardian in Islam
The word "guardian" comes from the root word "qiwamah," which means to take care of a matter or wealth, or to be in charge of a matter. In Islam, the woman's guardian is the husband (usually) or the guardian, and his role is to care for the woman's affairs and protect her by providing her with the legal expenses, treating her kindly, and looking after her interests. This responsibility is called "guardianship," which is based on God's preference of some over others, which requires the husband to be responsible for caring for his wife and guiding her if she deviates. One of the reasons why a man is given double the share of a woman's inheritance in some cases (only) is because he is always the guardian of a woman in Islam. If she is not a wife, then she is an unmarried sister, an unmarried daughter, a mother, or a grandmother who is supported by her. And God knows best.
3 - The Right to Water, Sanitation, and Hygiene
Menstrual hygiene remains a taboo topic in many parts of the world, depriving many women of safe, accessible, and clean places to wash and wash themselves. An estimated 2.5 billion people worldwide lack access to improved sanitation, many of whom are women. The consequences of discrimination against women and inadequate access to water and sanitation can be dire. Girls who menstruate may be unable to attend school due to the social stigma associated with it and/or inadequate sanitation and hygiene services at home and in schools.

The Comment
God Almighty said
(O you who have believed, when you rise to [perform] prayer, wash your faces and your forearms to the elbows and wipe over your heads and your feet to the ankles. And if you are in a state of major ritual impurity, then purify yourselves.) [Al-Ma'idah: 6]

When water is available in homes, workplaces, schools, or factories, it is preferable to use water because cleanliness in Islam is part of Islam, as stated in the noble hadith.

God Almighty said
(لا يُرِيدُ اللَّهُ أَنْ يَجْعَلَ عَلَيْكُمْ مِنْ حَرَجٍ) [المائدة: 6].
(God does not intend to place any difficulty upon you.) [Al-Ma'idah: 6]
If water is scarce in Islam, a Muslim may purify himself. With the available water as much as possible. If he does not find water or is unable to use it, it is permissible for him to perform tayammum with pure earth. This is a mercy to people. Not all people live under the same circumstances. There are wars, armed conflicts, famines, water scarcity, and other things. Islam’s mercy towards all types of people and respect for their values is a kind of mercy bestowed by this religion. There is no harm in reducing the use of earth, paper towels, or even some types of pebbles sometimes.
4 - Her Right to Adequate Homing
The right to adequate housing is a fundamental pillar of women's right to equality under international human rights law. While international and national laws increasingly recognize women's right to adequate housing, significant gaps remain between this recognition and the reality of widespread denial of this right. As a result of discrimination and unequal housing, many women and girls live in unsafe, degrading, and undignified conditions, increasing the risk of homelessness and violence. Forced evictions and other violations of the right to housing disproportionately affect women and reinforce existing inequalities, representing a significant obstacle to achieving gender equality. Examples of gender-based inequality and discrimination

The Comment
1 - The Right to Housing for the Wife
A woman has the right to independent housing, and her husband must provide her with such housing, in proportion to her circumstances and within the husband's means. The Prophet, peace and blessings be upon him, warned against the husband’s foreign relatives entering upon his wife, as reported by Uqbah ibn Amir: “The Messenger of God, peace and blessings be upon him, said: ‘Beware of entering upon women.’ A man from the Ansar said: ‘O Messenger of God, what about the in-law?’ He said: ‘The in-law is death.’” Narrated by Al-Bukhari: The in-laws: The husband's male relatives who are not mahrams to the wife. This noble hadith clearly indicates that a woman has her own residence and does not live in a family home, as in the case of living with her husband in his family home. It is possible for her to be alone under any emergency situation, such as being alone in the house with male relatives who are not mahrams to her. This is not considered suitable housing in Islam except under specific circumstances.

Al-Kasani (may Allah have mercy on him) said: "If the husband wants to house her with her co-wife or with her in-laws, such as the husband's mother, sister, daughter from another wife, or her relatives, and she refuses, then he must house her in a separate home. However, if he houses her in a room within the house (i.e., in a separate room) and makes a separate lock for this room, that is sufficient for her, and she does not have the right to demand another residence, because the harm caused by fear for her personal property and the inability to enjoy herself has been eliminated." Bada'i' al-Sana'i' (4/23)

2- The Right of Housing for a Divorced Woman
God Almighty said
أَسْكِنُوهُنَّ مِنْ حَيْثُ سَكَنتُم مِّن وُجْدِكُمْ وَلَا تُضَارُّوهُنَّ لِتُضَيِّقُوا عَلَيْهِنَّ
"Lodge them where you live, according to your means, and do not harm them in order to impose hardship on them."
5 - Her Right to Security
We strive to ensure that women's priorities are central to peace and security decisions at all levels. To achieve this goal, we address the social, cultural, and political barriers and protection risks that limit women's full participation in achieving and sustaining peace. Violent conflicts are known to disproportionately affect women and girls, exacerbating existing gender inequalities and discrimination. Women are also effective peacemakers in armed conflicts, yet their role as key players and agents of change in peace has been largely unrecognized. Recognizing and integrating women's diverse understandings, experiences, and capacities into all aspects of UN peace operations is essential to the success and sustainability of UN peacekeeping efforts.

The Comment
God Almighty said
﴿ الَّذِي أَطْعَمَهُم مِّن جُوعٍ وَآمَنَهُم مِّنْ خَوْفٍ﴾ [ سورة قريش: 4]
“Who fed them against hunger and made them safe from fear.” [Surah Quraysh: 4]

meaning for his sake. “And made them safe from fear” means for his sake. They were afflicted with hunger due to the lack of crops in Mecca, and they feared the elephant army.
The general meaning is that God bestowed upon the people of Mecca abundant sustenance, so that when they wanted food, they found it. The second blessing that God Almighty bestowed upon them was the blessing of security. God Almighty says in another verse, "...Then you will surely be asked that Day about pleasure." Ibn Abbas, may God be pleased with him, even said in his interpretation of "pleasure" that it refers to cold water. How many people in this life enjoy cold water in their homes? How many ironies! Others long for just one cold drink, yet they drink it hot in the middle of the hot summer days. Sincerity: Security is a primary requirement in Islam, whether this security is for an individual, his wealth, his family, his home, or his work. Today, passwords, credit card numbers, and other things have been added.

The Messenger of God, may God bless him and grant him peace, said, "It is not permissible for a woman who believes in God and the Last Day to travel a day and a night's journey except with a man of means." (A mahram for her) Summary of the hadith ruling: [Sahih]
This noble hadith contains a strong warning against a Muslim woman traveling alone without a mahram, even if she intends to spend the night in a foreign country, except under specific circumstances, such as if she is a resident or otherwise. The reason for this is that she will be safe and not be exposed to anything that would frighten her if she were alone and not with safe company. And God knows best.

The central idea of Islam
Islam is the religion of peace and one of the beautiful names of God Almighty (As-Salam). Among the requirements of God's name As-Salam are that you feel safe around you, and your neighbor feels safe from your evils - whether this neighbor is a husband/wife, children, relatives, or unrelated neighbors. Everyone feels safe from being betrayed by you. This is one of the requirements of God's name As-Salam. Whoever does otherwise is destroying themselves, not Islam. Treachery, betrayal, murder without guilt, and other such heinous crimes only return to their perpetrator from where they began. Our religion is a religion of security for all. Whoever enters it and does good deeds feels safe in themselves, their wealth, and their children among the pious believers. Anything other than that is deviant from this religion. A Muslim woman feels safe among her relatives as long as she lives. The truth is that long-lived Arabs are few, not many. We will not delve into the reasons for this now, the most important of which are (lifestyle, love, and the circles of good relationships around you, etc.). However, the female believers who enter nursing homes are few in the East, according to our limited knowledge, and not... With documented statistics.

6 - Her Right to Education
Girls' Education: Gender equality in education benefits every child. Investing in girls' education transforms communities, countries, and the world. Educated girls are less likely to marry early and are more likely to live healthy and productive lives. They earn higher incomes, participate in decisions that affect them most, and build a better future for themselves and their families. Girls' education strengthens economies and reduces inequality. It contributes to more stable and resilient societies that enable all individuals—including boys and men—to fulfill their potential. But girls' education is more than just access to school; it's also about girls feeling safe in classrooms and supported in the subjects and careers they choose—including those in which they are often underrepresented. When we invest in girls' secondary education,

Girls' incomes increase dramatically.

National growth rates increase.

Child marriage rates decrease.

Child mortality rates decrease.

Maternal mortality rates decrease.

Child stunting decreases.

Why aren't girls in school?
Despite the evidence that girls' education is crucial to development, gender disparities in education persist.

The reasons are many.
Barriers to girls' education—such as:
Poverty
Child marriage
Gender-based violence

vary across countries and communities. Poor families often prioritize boys when investing in education. In some places, schools don't meet girls' needs for safety, hygiene, and sanitation. In others, teaching practices are gender-insensitive, leading to gender gaps in learning and skills development. Gender-equitable education systems empower girls and boys and promote the development of life skills—such as self-management, communication, negotiation, and critical thinking—that young people need to succeed. It also helps close skills gaps that perpetuate wage gaps and contributes to building prosperity for entire countries. Gender-equitable education systems can help reduce gender-based violence in schools and harmful practices, including child marriage and female genital mutilation.

Gender-equitable education systems help keep girls and boys in school, which contributes to building prosperity for entire countries.

1. Tenure is linked to the relationship or family status, particularly in the event of marital dissolution, the death of a spouse, or during inheritance.

2. Discrimination and unequal access to economic opportunities and the financing needed to own or rent a home.

3. Exclusion from participation and decision-making processes related to housing and urban planning, which contributes to inadequate housing conditions that meet the needs of women and girls.

4. Increased vulnerability of women and girls to domestic violence and sexual assault, particularly when alternative safe housing is unavailable or when they live in displacement.

5. Lack of clean water, sanitation, or other facilities that provide privacy, including menstrual hygiene.

The Comment
Knowledge is an obligation for every Muslim, and as long as it is an obligation, neglecting it is a sin, just as is the case with prayer and fasting. Since women are equal to men in terms of rulings, duties, and rewards, except for what is specific to men alone, or what is specific to women alone, then knowledge is an obligation for Muslim women. In Islam, it is primarily: what is essential to the religion (the knowledge by which one knows how to pray correctly, fast correctly, and interact with people correctly, etc.), then worldly knowledge such as medicine, engineering, astronomy, and other sciences that help build the universe. Islam did not create dervishes who only know how to chant dhikr in mosques and have no life outside of the mosque,  The Messenger of God, may God bless him and grant him peace, praised the first three centuries of the Islamic nation, saying, "The best of people are my generation, then those who come after them, then those who come after them, then there will come people who..." The testimony of one of them precedes his oath, and his oath precedes his testimony. So what was their situation with regard to knowledge and action? They were men of encyclopedic thought and knowledge. None of them specialized in the religious sciences that appeared later, approximately in the Abbasid era, with the emergence of theology, philosophers, Islamic jurisprudence, and other specialized sciences that divided Muslims from a nobler goal than the abhorrent specialization. This is, for example, not limited to “Dawud al-Antaki.” This man, without going into the details of his biography, was called “the Sheikh of Physicians of his time.” He was a Sheikh in the general sense: “jurisprudence, knowledge of Sharia, piety, night prayer, remembrance, supplication, etc.” However, his title “Sheikh of Physicians” does not correspond to our day: “Head of Physicians.” We do not say in a specific country, but rather he was a transcontinental. He grew up in the town of Antioch in Turkey, lived in Saudi Arabia, then immigrated to Egypt and built a medical school there. Read carefully, “for medicine, not for jurisprudence.” His day in Egypt began with dawn. He prayed, and then the students of the medical school he established in Egypt would enter to him. He was blind, so he would dictate from his mind to the students what he dictated in a notebook or two. Then they leave and another group enters and he dictates to them the same, and so on until sunset, then he ends his school day with the students, to sleep after dinner and then he says to pray the night prayer, and his life journey continues like this. This is one of the imams of Muslims who were known in the first three centuries, and we will not forget his likes such as Al-Basri, Ibn Sina and others. We were raised on the belief that we were only created for worship, and with simplistic, not profound thinking. What about the infidels? Muslims are about a third of the world, and the other two-thirds are non-Muslims. If we were created only for worship, then why were two-thirds of the earth created? And we shall not say that they were not guided to the fitrah? We were created for worship; this is something fundamental to our religion, and the other origin is: We came for construction. God Almighty said, "And settled you therein." So if we do not develop with medicine, engineering, astronomy and chemistry, then with what will we develop? The other principle is that we came because we are God's successors on earth. God Almighty said to Adam, peace be upon him, "And we are the children of Adam: 'Indeed, We have made you a successor on earth.'" What kind of succession is that then? Is the application of the Quran on the ground merely to reflect the entire religion? Yes, this is an essential part of our religion, for people to know Islam, love it, and willingly embrace it. However, people follow the dominant trend and are eager to follow it step by step, while the entire world is ahead by steps. So how can people follow this religion when they are not superior in developing the world through knowledge and action combined?

My dear brother, in some Islamic countries, female Muslim students are denied education after primary school, under the pretext that it is shameful or impossible to learn. Return to the correct understanding of the religion, and do not burden yourselves with what you cannot bear on the Day of Judgment by depriving girls of the blessings of this world, the most honorable of which is knowledge. God Almighty is known for knowledge and love, not fear and awe.
7 - Her Right to Marry
Article 12 protects the right of men and women of marriageable age to marry and to found a family.

Your right to marry is subject to national laws relating to marriage, including those that criminalize marriage between certain categories of people (such as close relatives). While the government has the power to restrict the right to marry, any restrictions must not be arbitrary or conflict with the fundamental principle of this right.

How does this right apply to transgender people?
The European Court of Human Rights ruled in 2002 that this right extends to transgender people. They have the right to marry or enter into civil partnerships based on their acquired gender under the Gender Recognition Act 2004, the Marriage (Same-Sex Couples) Act 2013, and the Marriage and Civil Partnership (Scotland) Act 2012.

“And among His signs is that He created for you mates from among yourselves, that you may find tranquility in them, and He placed between you affection and mercy. Indeed in that are signs for a people who give thought.” [Ar-Rum: 21]

And among His signs demonstrating His greatness and perfect power is that He created for you—men—mates from among your kind, so that your souls may find peace and tranquility in them. He placed love and compassion between a woman and her husband. Indeed, in this creation of God are signs demonstrating His power and His Oneness for a people who reflect and ponder.

Allah Almighty has decreed for the Muslim woman in Islam (marriage) and this is what it should be, and this marital system should also have “affection and mercy” and this is what it should be, and He has made it the correct Islamic nature, so deviants or what they call in the West (homosexuality) or in some Eastern countries is not part of nature under any circumstances, and if you follow the matter psychologically, medically and otherwise you will discover that for yourself, the most important thing is that Allah Almighty is the one who created creation from the beginning of creation and until the last Day of Judgment, except that some scientists also create but from the living cell DNA so they do not create from zero as it is said, rather they manipulate the living cell with CRISPR scissors and create, and the most beautiful and fair thing is that Allah Almighty came in a verse in the Qur’an that says “So blessed be Allah, the best of creators” so He was fair to the scientists from Himself, glory be to Him, and the most beautiful and fair thing is that you do not trust anyone who tells you I create something from nothing, because this is nonsense, Allah Almighty alone did, does and will do that - within the limits of our limited knowledge - and we will not make excuses for Allah Almighty, and in At the same time, we respect science, but it is changing and has a very difficult cycle to reach its intended goal, such as cryogenics, which scientists claim can revive the dead, or at the very least, awakening from a deep sleep for a long period of 6 months, for example, for astronauts traveling from planet Earth to other planets to shorten the boredom and fatigue of this journey, and this is just one example.

Women have the right to marry in Islam, and they have fundamental rights in this regard, including:

The Right to Choose and Refuse
A woman has the right to choose whom she marries. Her guardian has the sole role of guidance and counsel, and he may not force her to marry someone she dislikes.

The Validity of the Contract
Marriage requires the woman's consent and approval, and her consent is a prerequisite for the validity of the contract. Marriage is not legitimate without mutual consent.

The Right to Refuse
If a woman is forced into marriage, she has the right to refuse or annul it, as the hadiths explain.

The Right to Choose a Spouse
Islam grants women the right to choose their spouse without any coercion. A marriage contract without their consent is invalid.

The Equality
Men and women enjoy the right to choose marriage and to start a family once they have reached the age of marriage.

“And among His signs is that He created for you mates from among yourselves, that you may find tranquility in them, and He placed between you affection and mercy. Indeed in that are signs for a people who give thought.” [Al-Rum: 21]

Women have the right to marry in Islam, and they have fundamental rights in this regard, including

8- Her Right to Reproduction
Choosing whether or not to have children? The freedom to choose the number, spacing, and timing of their children. Everyone has the right to receive the information, education, and support necessary to make these decisions. Decisions must be based on the best available information. During childbirth—even when things don't go as planned—their rights are violated. When care is not cooperative, unhealthy conflict arises that may harm the mother or the baby. There are strategies to protect both mother and baby from abuse, neglect, and maltreatment. Examples of disrespect include slapping or pinching during birth, verbal abuse, and the use of harsh or abusive language. Patient-centered partnerships achieve the best outcomes, although obstetrics can be tedious, psychologically exhausting, and require a lot of emotional support for women. The Comment
Anas's hadith says: "Marry the loving, fertile woman, for I will be proud of your great numbers on the Day of Resurrection." Narrated by Ibn Hibban. Al-Shafi'i cited it as a report from Ibn Umar, with the wording: "Marry and multiply your numbers, for I will be proud of you before the nations." Al-Bayhaqi cites a hadith from Abu Umamah: "Marry, for I will be proud of your great numbers before the nations, and do not be like the Christian monks."

We discussed above the Western trend toward sterilizing women in some states of the United States and some European countries, as a type of unregulated policy in other parts of the United States. As far as we know, this sterilization is not documented, such as a signed consent form, but rather forced, which Islam does not accept. A Muslim woman has the right to have children if she so desires. We believe, to the best of our limited knowledge, that this is a type of natural selection policy implemented by scientists. The idea is that those with a family history of mental or even physical disabilities are sterilized without consent, because this costs the state enormous sums of money to treat and care for these disabled individuals. The ethical question that remains is: From a financial perspective, they may be right, but from a psychological perspective, how can we do this to people who don't even know something like this has happened to them? As for marriage between relatives, the hadith states, "Do not marry close relatives, for the child will be born weak." That is, marry strangers rather than relatives, for the child of a stranger is more virile and stronger than the child of a close relative. A woman may have a weak child if she gives birth to a weak child. The meaning of "do not give birth to weak children," i.e., weak and thin. The singular form is "dawī."

Here we can say that Islam did not prohibit Muslim women from marrying relatives in every way, nor did it leave it to the custom of Arab tribes, who marry their daughters to their relatives from a young age by mutual agreement, and upon reaching marriageable age, they marry them to whomever they agreed to marry. The Messenger of God, may God bless him and grant him peace, said in another hadith: "You are more knowledgeable about your worldly affairs." The matter is left to the circumstances of each era. As far as our limited knowledge is concerned, Muslims have the highest rate of marriage to relatives in the entire world, after India and some Asian countries. The highest rate, among those we do not remember well, is in Pakistan. Yet, despite this, the Messenger of God, may God bless him and grant him peace, married his cousin, Zainab bint Jahsh, and married his daughter, Fatima, may God be pleased with her, to his cousin, Ali ibn Abi Talib, a close relative. So, how can this be a contradiction? There is no contradiction. Marriage to relatives sometimes brings great benefits, such as inheriting beauty, intelligence, or long-lived families. However, if there are recessive diseases inherited in one generation, it is very likely that they will be passed down through the generations, and problems may occur in the first generation itself. Most important:

So, we should not say that God Almighty has denied Muslim women one of their innate rights to life. Rather, it is possible for a father to propose marriage to his daughter to someone he deems righteous. He only prevented her, as a Muslim woman, from marrying someone of the same sex, and called it perversion, not homosexuality.
9 - Women's Right to Privacy
We often talk about privacy as if everyone benefits equally from the same privacy laws, as if we are all equal. When we do this, it reveals how our privileges are normalized, and that we are not ignoring how privacy violations affect people of different classes and genders very differently. We do not consider the role of patriarchy in establishing these unequal standards. Privacy should be a choice, but this is far from the truth. For most women, especially those living in poverty, ignorance, and male servitude, privacy remains a distant dream. The United Nations Human Rights Council and the United Nations General Assembly have expressed their concern and appreciation that "violations and abuses of the right to privacy in the digital age may affect all individuals, with particular repercussions for women, as well as for children, people living in vulnerable situations, or marginalized groups." They urged states to work to prevent violations of the right to privacy for all individuals, especially women, children, and vulnerable groups in society, and to develop appropriate solutions to address this issue. In this digital age, where privacy is easily violated, we must realize that appropriate privacy laws, with a greater focus on women and other vulnerable groups in society, and their strict implementation are required.

The Comment
A Muslim woman, wherever she may be, has the right to the following: It is necessary to know what this should be.

Preventing Spying
God Almighty said:
(O you who have believed, avoid much [negative] assumption. Indeed, some assumption is sin. And do not spy…) Surah Al-Hujurat
It is a fundamental right for her, just as it is for a Muslim man, that no one has the right to spy on her. In the noble hadith: On the authority of Abu Hurayrah (may God be pleased with him), the Messenger of God (peace and blessings be upon him) said: "If a man were to look at you without permission and you were to hit him with a pebble and put out his eye, there would be no blame upon you." Despite this, people spy on each other in various ways today, starting with advanced technologies. Perhaps someone (security agencies) might spy on a woman, such as Voice to Skull technology, knowing what is going on in her mind at the exact time she is actually thinking about the matter. With mobile technologies, through some Windows operating systems starting from Windows 10 and above, it reads what is going on in your mind. This is in addition to the artificial intelligence that is downloaded onto your mobile device, laptop, or other modern devices via Internet browsers without your choice. Notice, for example, when you talk to a deep thinking artificial intelligence, it talks to you and knows you and knows exactly what you are doing and deals with you by name and some information that you are surprised it knows and you have never stored it in its non-human mind!!! This is in addition to the electronic chips that are placed in some pets to spy, where these animals roam around you and take snapshots of every meter in your house specifically and can capture the speech in your head and other things. The witness: As we said above (Do not spy: this is what should be) and this is what does not happen in reality, especially for Muslim women in the West. Let us not forget the technology of "The big brother watching you":
10 - The Right to Fair and Respectful Treatment
Freedom from threats and violence at home, when accessing services, and at all other times. Threats and violence are always wrong, even if perpetrated by a family member or a healthcare worker. Everyone has the right to live a life free from discrimination. Discrimination occurs when people are not treated fairly because of their age, gender, race, place of residence, or other factors.

The Comment
The right to treat women with respect and appreciation is highly valued in Islam. The Qur'an and the Sunnah emphasize the equality of men and women in humanity and honor.

A - Equality in Creation and Human Dignity
The Qur'an recognizes that men and women were created from a single soul and are equal in humanity and dignity before God.

B - Love and Mercy in Marriage
The Qur'an describes the marital relationship as built on affection and mercy, likening spouses to clothing for each other, demonstrating complementarity and compassion.

C - Balanced Rights
The Qur'an affirms that women have rights over men, just as men have rights over women, in a balanced and fair manner. God Almighty says in Surat Al-Baqarah: "And women have rights similar to those against them, according to what is equitable."

D - Encouraging Knowledge
Numerous Quranic verses encourage both men and women to pursue knowledge and promise them a great reward.

Before we continue: This is as it should be, because—especially when this topic is in English—you will find many differences in reality. Islam has guaranteed this treatment for Muslim women from above seven heavens. Anyone who does otherwise is an aberrant, not a Muslim.
1 - Her Right Not to Be Forced into Marriage
Child and Forced Marriage, Including in Humanitarian Situations. Child and forced marriage are a human rights violation and a harmful practice that disproportionately affects women and girls worldwide, preventing them from living lives free from all forms of violence. Child and forced marriage threaten the lives and futures of girls and women around the world, robbing them of their ability to make decisions about their lives, disrupting their education, making them more vulnerable to violence, discrimination, and abuse, and preventing their full participation in economic, political, and social spheres. Child marriage is often accompanied by early and repeated pregnancies and childbirth, leading to higher than average rates of maternal morbidity and mortality. Child and forced marriage may also push women and girls to attempt to flee their communities or commit suicide to avoid or escape marriage.

The Comment
In Islam, women have the right not to be forced into forced marriage
Her consent is a prerequisite for the validity of a marriage contract. Islamic law affirms this right through Prophetic hadiths and legal principles, and mandates that guardians play a role in protecting their interests, not coercing them.

The Consent as a Basic Condition for Marriage
Hadith of the Prophet Muhammad (peace and blessings be upon him): The Prophet said: "A widow should not be married until her permission is sought, and a virgin should not be married until her permission is sought." Scholars interpreted this hadith to mean that a previously married woman (a widow) should have her opinion explicitly sought, while a virgin's silence is sufficient as permission. This is understood within the context of modesty preventing her from expressing her opinion.

To the best of our limited knowledge, some Chinese women are kidnapped for marriage in some Chinese tribes. Their educational level, social standing, or professional achievements are irrelevant. What matters is that if someone wants her for marriage, even if they are uneducated or only do robbery, plunder, or other such activities, they send someone to kidnap her. She goes to marry him, and is required to serve his family and even his tribe without complaint or complaint. May God protect Muslim girls. Another example is in Africa, in extremely poor countries and villages, Afghanistan, and other Muslim countries. Unfortunately, girls are forcibly sold into marriage to wealthy men for a handful of dollars. This has nothing to do with true Islam. Marriage should be based on love and mercy, and its foundation is housing. The meaning of the word "house" in Arabic comes from the word "house," meaning a place to relieve pain, perhaps psychological, social, or even physical. Marriage has great value for individuals, groups, and societies, and only those who wish harm upon their society would overlook it.

12 - The Right to be Free from Sexual and Gender-Based Violence
Office of the United Nations High Commissioner for Human Rights, Women's Human Rights, and Gender Equality. The Declaration on the Elimination of Violence against Women defines "violence against women" as any act of gender-based violence that results in, or is likely to result in, physical, sexual, or psychological harm or suffering to women, including threats of such acts, coercion, or arbitrary deprivation of liberty, whether occurring in public or private life.

The Comment
To the best of our limited knowledge: We do not know of anything in the religion that calls for this other than the verses on hijab, especially the Almighty's saying: "O Prophet, tell your wives and your daughters and the women of the believers to bring down over themselves [part] of their outer garments. That is more suitable that they will be known and not be abused..." (Surat al-Ahzab). Islam has established that the hijab, and perhaps the niqab in some places, such as among Arab tribes, should not be used to distinguish a woman from others. The reason for "not being abused" is that some women may be known for their outstanding beauty, such as foreign Western women. If someone follows them, they may be abused because of their beauty, wealth, or other reasons men unjustly desire in women. Not all men are of one mind in faith, piety, and devotion to God. And God knows best.
13 - The Right to Be Free from Female Genital Mutilation
The types of Female Genital Mutilation: Female genital mutilation is classified into four main types:

Type I
Is the partial or total removal of the clitoral glans (the external, visible part of the clitoris, a sensitive part of the female genitalia) and/or the prepuce/clitoral foreskin (the fold of skin surrounding the glans of the clitoris).

Type II
Is the partial or total removal of the clitoral glans and the labia minora (the inner folds of the vulva), with or without removal of the labia majora (the outer folds of vulvar skin).

Type III
Also known as infibulation, it is the narrowing of the vaginal opening by creating a protective seal. This seal is formed by cutting and repositioning the labia minora or majora, sometimes with sutures, with or without removing the clitoral foreskin/clitoral foreskin and glans.

Type IV
Includes all other harmful procedures performed on the female genitalia for non-medical purposes, such as piercing, piercing, incision, scraping, and cauterization of the genital area.

The Comment
When God Almighty allows it, we will devote an entire article to it from a medical, physical, psychological, and social perspective, and perhaps from another perspective, to gain a better understanding of this matter.
14 - Her Right to Community Participation

Everyone has the right to
• Express their opinions and ideas at home, at work, in services, in a committee, or on social media.

• Meet with others without fear, such as holding a public meeting or a private gathering, such as with friends and neighbors.

• Participate in community planning and decision-making on issues affecting their health or the health of their family.

• People can also participate through a freely chosen representative, such as a local council member or union official.

The Comment
As you read above, social participation is not limited to parliamentary and legal councils, Shura and People's Councils, and other such councils that fall under the purview of the law. Rather, it also includes meeting with people in social gatherings, whether family or acquaintances. This includes work, education, and other rights, from which a Muslim woman may not, under any circumstances, withdraw unless she commits a crime that is reprehensible to society. Otherwise, whoever deprives her of the right to meet with people has committed a crime against her and deserves divine punishment before criminal punishment.
The General Comment on the Above
After all that has been said above, no rational person can even imagine that God Almighty would diminish women's rights at the expense of men, and that this religion is patriarchal and perpetuates the idea of masculinity in societies. On the contrary, we can confidently say that God Almighty—if that is the right expression—was the first to call for the rights of women and children (especially orphans) in His final message, just over 1,000 years before the establishment of Human Rights Watch.
